Hi, I had exactly the same problem as you with my 2009 diesel 3 Series. It's probably really down to the swirl flaps. At my garage, they replaced the entire intake manifold including the swirl flaps because the flap was broken, just like the other buddy here. The repair cost me around 900 euros, including labor and materials. It was expensive fun, but afterwards the car was fit again. The whistling noise can also indicate a defect in the swirl flaps, because I had that too. That's my experience with it - it was expensive, but everything worked perfectly again afterwards.
