Problems deactivating start/stop via the Carly app

I have a 2022 BMW 3 Series with 39,000 km on the odometer and am experiencing problems with the automatic engine shutoff. Additionally, I can't permanently deactivate the start/stop system via the Carly app. In principle, it should be possible to leave the start/stop system off by default, so it only activates via eco mode or the start/stop button. However, when restarting the car, the system remains deactivated. Does anyone have experience with this problem or tips on how I can solve this?

This vehicle has the latest software version; when referring to a dealer (with factory tools), there is no further advantage to using Carly. In my opinion, with some experience in vehicle technology (Bachelor in Automotive Engineering), the malfunction is not in the vehicle but attributable to the application, adaptation, and up-to-date status of Carly and the app. Can something be changed about this?
